I think we will all need to have a look at the detail. On the face of it it's less draconian than I expected (that doesn't make it a good thing!) but something like a review of the effectiveness of the Equality Duty is hardly surprising. A significant issue for me will be what happens with the compliance infra- structure. Arguably the creation of EHRC was already a step in the direction of eroding the previous equalities regulatory and compliance infrastructure by the last government. In the absence of a robust infrastructure to address failures of compliance the effectiveness of retaining liabilities and the power to recommend is weakened anyway. What's really chilling is the ongoing dominance of the political narrative in all mainstream parties that reduces the role of public services in providing equity as a public good to a pesky bureaucratic inconvenience. If wasn't for those darn kids we could have got away with it too!

Ministerial announcement on Equalities Red Tape Challenge and reform of the EHRC
The Home Office has just announced the outcome of the Equalities Red Tape Challenge and the Government response to the consultation on the reform of the Equality and Human Rights Commission. Please see attached ministerial RTC and EHRC statement.
The key announcements are:
The Government has published consultation documents on the removal of provisions relating to:
· employer liability for the harassment of an employee by a third party e.g. a customer;
· the power of Tribunals to make wider recommendations in a successful discrimination case; and the statutory mechanism by which individuals can obtain information where they think an employer, or service provider, has acted unlawfully towards them.
The government will also:
· proceed with the repeal of the socio-economic duty;
· delay commencement of the dual discrimination provisions in the Equality Act 2010;
· delay commencement of reasonable adjustments to common parts provisions.
The government committed last year to assess the effectiveness of the public sector Equality Duty (PSED) specific duties. They have decided to bring forward that review and extend it to include both the general and specific duties to establish whether the Duty is operating as intended.
