I am looking for advice regarding EIR. I am currently writing my dissertation as a part-time student (and CLO at Plymouth), and am considering the reasons for and against producing a local GAC for arsenic due to naturally elevated levels in the area.
I had hoped that I would be able to use data that is held by Plymouth City Council from planning applications and other sources as an indication of background levels in the area, because I thought this information would be available under EIR as it is published on the website, as long as I acknowledged the original sources. However, I have sought advice from my University and the Data Protection Officer and don't really seem to be able to get a clear steer.
Does anyone know whether this information is considered public and can be used (referenced of course), or do I have to get permission and if so is it from the consultant and/or the person whom commissioned the report?
I would be very grateful to anyone who can help or point me in the right direction.
