Scotland has its own RCL Regs - which I made a summary of as follows:
"Radioactive Contaminated Land was initially excluded, by Section 78YC of the Environmental Protection Act 1990, from the provisions of the existing Part IIA regime. The extension of the Part IIA regime to include radioactivity delivers a longstanding policy commitment of the Scottish Ministers to complete the package for dealing with contaminated land affected by radioactive contamination arising from historical industrial activities is regulated through Part IIA through the modification of Part IIA legislation by:
The Radioactive Contaminated Land (Scotland) Regulations 2007 - Scottish Statutory Instrument 2007 No. 179 amend Part IIA and came into force in Scotland on 30th October 2007. The Radioactive Contaminated Land (Scotland) Amendment Regulations 2009 - Scottish Statutory Instrument 2009 No. 202 amend The Radioactive Contaminated Land (Scotland) Regulations 2007and came into force in Scotland on 26th June 2009. •The Radioactive Contaminated Land (Scotland) (Amendment) Regulations 2010 - No. 2153 - amend The Radioactive Contaminated Land (Scotland) Regulations 2007 and came into force in Scotland on 30th September 2010. The general concept of the Radioactive Contaminated Land is in keeping with Part IIA and Regulations as amended, however there are subtle differences in the operation / implementation of the Radioactive Contaminated Land Regulations and these are outlined within the Scottish Government's Guidance document on the Radioactive Contaminated Land (Scotland) Amendment Regulations 2009, The Radioactive Contaminated Land (Scotland) Amendment Regulations 2009: Statutory Guidance Paper SG/2009/87. http://www.scotland.gov.uk/Publications/2010/03/19125743/0
The regulations specifically exclude land that is part of, owned or occupied by a nuclear site operator for which a nuclear-site licence is in place as there are sufficient regulatory controls already in place through the Nuclear Installations Inspectorate (NII) of the Health and Safety Executive (HSE) to require remediation if necessary."
