It is subject to employment law. You can't assume they have a right to work for you. They may only have permission to work for their home institution. If you class them as employees, you have to go through the same checks as any other employee. If the UKBA were to ask, could you prove they all had the right to work in the UK?
Having said that, I'm not sure what we do - not my area!

UKBA have issued guidance stating that, if an external examiner does not already have permission to work in the UK, then they need Tier 5 permission to conduct external examiner duties in the UK.
The majority of our external examiners are employed by UK institutions and so we would assume that they already have the correct permission to work and that this was being checked by their employing institution. However, it has been suggested that we should really go one step further and specifically ask external examiners as part of the appointment process whether or not they have permission to work in the UKBA (and possibly even request copies of passports for all external examiners). How are others handling this?
