The query isn't specifically DPA more EIR but I want your views as to
whether you believe there is any DP issues involved.
Complaint received from tenant regarding state of property.
Housing officers inspect the property after serving a notice of entry
(addressed to both tenant and landlord) under provisions of Housing Act
2004 and a schedule of works/report is produced. Notice is served in
the landlord and any other defined interested parties which includes the
tenant.
Tenant has withheld rent on the advice of a solicitor until the defects
are corrected.
Tenant has been served with a Section 21 notice (Housing Act 1988) -
notice to quit because of outstanding rent arrears.
Tenants representatives have requested a copy of schedule of
works/report to support their clients case.
I am wondering why, when copies of everything else is sent to the tenant
the schedule of defects isn't? Should the information be disclosed? Are
their any DP implications in relation to the landlord? I don't think
there are but I'm happy to be corrected.
