Would the RSPCA be the prosecuting authority? If they can evidence some statutory power to prosecute, we would consider disclosure.
If not, Section 35(2) may give you a gateway?

Subject: [data-protection] RSPCA & Section 29
I haven't researched this yet but needed a quick answer if possible. Do the RSPCA have the right to make a Section 29 request ? We have evidence of persons threatening to abandon an animal which they then did, and the RSPCA have asked for transcripts of the telephone conversation and also their contact details. RSPCA are claiming breach of Section 9, Animal Welfare Act.
Somewhere in the back of my mind I thought they had to be backed by the police or is that just for entering premises where animal cruelty is supected ?
