I was involved with something similar a good few years ago now, Not my case, one of my colleagues. Basically it involved a known alcoholic admin person who was being referred re FFW and HR wanted us to do a test to confirm that she was attending work under the influence. They kept sending her down when she attended work and they thought she was drunk wanting a test done. We discussed it as a group of OH Nurses and went back to HR with the opinion that she was not fit for work and left it at that.
The organisation did have a drug and alcohol policy. Our Consultant got involved and I remember being in the office the day that the HR Advisor concerned phoned to ask him the same questions about the client's alcoholism. His response was "look my advice to you is, if it looks like a duck, walks like a duck and sounds like a duck...IT's A DUCK....oh I think I've just had the phone put down on me." She wasn't referred again and I believe that they dealt with it under the policy as the management issue that it was.
