Hi,
We looked at Mail Chimp and our Info Management team had similar concerns about data protection outside the UK. However if you check MC's Privacy Policy it says that they do work in accordance with the data protection laws.
They are also notified with the UK Info Commissioners Office as a "Data Controller", registered number Z1907965.
This satisfied our info management policies, as long as newsletter receivers were notified how their data was used and given the option to remove their info from the list at the point of changing provider

We are looking at moving to a similar email distribution service and I have been impressed with Campaign Monitor, especially as they adhere to the email standards group. However, we have been advised legally that using these two services would breach data protection law as you are exporting personal data outside of the UK and EU if you move your existing contacts list to these new services. This may be something that is of concern to you.
I recently looked at dotmailer as they are UK based and seemed to be as good as the other two, but they wanted a £450 setup fee which we do not have the budget for, which leads me on to ask does anyone know of a good UK based alternative that is as cheap as CM and Mail Chimp?

I'd go Mailchimp or Campaign Monitor, and not touch any of the others with someone else's bargepole :-)
I used to use Campaign Monitor - really great tool, but then for one reason and another moved to Mailchimp. Now I hear CM has upped its game so it may be worth looking at that again.
Templates - you should be able to do what you want, and there are loads of resources online with templates you can fiddle with. Mailchimp themselves have a pack you can download: http://www.mailchimp.com/resources/html-email-templates/
