Could anybody please suggest me cases related to the use of Land Registry UN1 - unilateral notice form - I may be interested to be aware of as the conveyancing process I started last February has ended in a sort of maze?
Following my research partially reported here on March 4, I had access to the Title Register for the property I was interested in and discovered a really complicated situation. Not only the person who was supposed to be the absolute proprietor is not even mentioned but serious concerns arose about the fact this person was / is still legally entitled to sell the flat.
Briefly said, an abusive pattern that resemble what is commonly known as "property fraud scheme" has emerged, connected with welfare / housing benefits management. Having reported everything to local authorities, National Fraud Hotline, London County Court, Metropolitan Policy - Fraud Unit, and others I am perfectly confident that the truth will emerge and everything will be clarified.
In the meantime, I asked the Land Registry to put a UN1 note registering my interest to buy the existing leasehold (that was what allowed the entire possible fraud to be discovered) and got a surprisingly rapid answer that seemed to me completely inconsistent with the current Land Registry rules in that, I was required to resend it as an "agreed" notice and to let them know who these proprietors are - that is exactly what I do not know and it could be very difficult to discover.
In fact the ultimate owner of the companies involved in a sort of "leaseholds maze" in the building is a public company that has recently transferred about the 90% of its shares to a sort of blind trust in the Channel Islands. And as far as I can say this is basically impenetrable unless, I was advised by a very competent expert in fiscal corporate issues, I stopped to pay taxes because this could make the entire "stuff" discoverable. While I would put myself at risk of an illegal conduct, for the sake of the fiscal justice? Or for the amusement of somebody who is playing a very abusive legal simulation game?
