I'm sure some of the luminaries on this list have got to grips with this issue, so here goes:
Most of our brownfield sites being redeveloped fall under EWC code 17 05 03* or 17 05 04 in terms of soil being excavated for disposal. in this context, what is the definition of a "contaminated site"? I have a brownfield site where all but one sample is classified as non hazardous using the WM2 methodology. There are low concentrations of contaminants present ie PAH, TPH, PCBs (extremely low) and metals etc but these are below hazardous thresholds (but are classed as dangerous substances). As the materials classify as non-hazardous, is there the option to dispose of the material as inert? To dispose of C&D soil waste to inert landfill, the waste has to classify as 17 05 04, which specifically excludes soil and stones from 'contaminated sites'. Hence the request for this definition.
Is it as simple as: if the waste classifies as non hazardous and then meets chemical criteria for inert waste, it is always automatically eligible for inert disposal?
The EWC seems to be silent on the definition. Clear as mud as always!
