Well, I'm definitely not defending restrictive practices: FWIW I completely agree with you.
First off, I didn't know much about NVivo and its uses and Zena's email made me wonder if anyone here did; so that's really useful - thanks.
But secondly, as Emma says in her reply, when it comes to ILL's and electronic copyright we are governed by law and, whatever our opinions may be on the rights and wrongs of the law we don't have much choice but to do our best not to break it. But having now looked at Zena's email properly it seems she is not talking about ILL's, I just thought she was. So I'll go away again!

Just wearing my gamekeeper turned poacher hat as an academic.
Using NVIVO or similar software would be an accepted methodology for
conducting a qualitative systematic review. You would code up the
articles for themes and then interpret their similarities and differences.
Two observations:
1. Systematic reviews as a movement have probably done more for the
profile of librarians/information specialist than any single academic
endeavour;
2. Given that journal articles are written by academics, reviewed by
academics and edited by academics is there any reason why librarians
should be morally inclined to represent the interests of the journal
publishers more than the interests of the academics (as users/producers)
of the organisations which employs them and pays for their services?
Finally the open acess argument would be that if the TEXT of every
journal article was available via the digital repositories then this
sort of data mining endeavour where you are adding value to the research
already paid for by public monies would be much more feasible and less
vulnerable to the restrictive practices of the commercial publishers.
