CONMEMORACIÓN DEL DÍA INTERNACIONAL PARA LA ELIMINACIÓN DE LA VIOLENCIA CONTRA LAS MUJERES
CONTRA LA ESTERILIZACIÓN FORZADA DE LAS NIÑAS Y MUJERES CON DISCAPACIDAD

El Foro Europeo de la Discapacidad (EDF) se suma hoy 25 de noviembre, Día Internacional para la Eliminación de la Violencia contra las Mujeres, a la lucha contra toda forma de violencia de género de la que son víctimas miles de mujeres en la Unión Europea y en el mundo.
A la luz de la Convención de Naciones Unidas sobre los Derechos de las Personas con Discapacidad (en su artículo 12 Igual Reconocimiento ante la Ley, Artículo 16 contra la Explotación, la Violencia y el Abuso, Artículo 17, Protección de la Integridad Personal, y en su Artículo 23 sobre el Respeto del Hogar y La Familia), el EDF reconoce la esterilización forzada como una forma de violencia que vulnera el derecho de las personas con discapacidad a fundar una familia, a decidir sobre el número de hijos, a tener acceso a la información sobre la planificación familiar y reproducción, y a mantener su fertilidad al igual que el resto de seres humanos.
Por todo ello, DECLARA
Que, en los diferentes países de Europa, existe evidencia clara de que la esterilización forzada se sigue practicando en muchas personas con discapacidad; en especial, niñas y mujeres con discapacidad mayoritariamente intelectual o psicosocial sin su consentimiento, o sin que ellas comprendan el objetivo concreto de la operación quirúrgica, llevándose a cabo bajo la premisa del bienestar de la propia persona con discapacidad.
Que, para muchas niñas y mujeres con discapacidad esta experiencia supone una negación de su acceso a los servicios apropiados, viéndose forzadas contra su voluntad, intimidadas, presionadas, violadas e incluso privadas, a veces sin saberlo, de sus derechos humanos fundamentales, como son salvaguardar su integridad corporal y controlar su salud reproductiva.
Que, cuando la niña o mujer con discapacidad se encuentra en una situación de incapacitación legal previa o no ha alcanzado la mayoría de edad, y es necesario obtener el consentimiento de los padres o de la persona que la represente, este consentimiento debe estar basado en el respeto de los derechos humanos y la voluntad de la niña o mujer con discapacidad en todos los casos. Además es responsabilidad del personal médico relevante asegurarse de que la niña o mujer con discapacidad ha sido informada adecuadamente de que la intervención médica o quirúrgica que va a ser practicada supone su esterilización, así como de sus consecuencias futuras.
Que, las niñas y mujeres con discapacidad tienen el mismo derecho a la maternidad que otras mujeres. La provisión de servicios adecuados es la solución para asegurar que las mujeres con discapacidad puedan disfrutar de este derecho plenamente.
Por todo esto, el EDF EXIGE:
. Que desde los poderes públicos se revise la normativa legal que regula la esterilización forzada, abordando las cuestiones relativas al "consentimiento informado" y a la "capacidad legal", para lograr el ajuste necesario y cumplir con el espíritu y obligaciones de la Convención, que demanda la introducción de reformas que asuman que el respeto del hogar y la familia, la dignidad y la integridad de una persona con discapacidad son derechos fundamentales, que no pueden verse vulnerados.
. Que se elaboren estudios que den a conocer la realidad de la esterilización de las personas con discapacidad en Europa, con perspectiva de género, edad y tipo de discapacidad, facilitando estadísticas exactas sobre la esterilización forzada y terapéutica.
. Que se pongan en marcha las necesarias medidas de sensibilización, información y formación dirigidas tanto a las familias de las niñas y mujeres con discapacidad más vulnerables al riesgo de esterilización forzada, como a los profesionales -especialmente de la medicina y de la judicatura- para que escuchen a las niñas y mujeres con discapacidad en los procesos de investigación. Estas medidas deben tomarse en cooperación con las organizaciones representativas de las personas con discapacidad.
. Que deben desarrollarse planes adecuados con el objetivo de asegurar que las niñas y mujeres con discapacidad embarazadas consiguen apoyo para prepararse para la maternidad y que las madres con discapacidad que necesiten apoyo para el cuidado de sus hijos tengan acceso a la asistencia y servicios adecuados.

COMMEMORATING THE INTERNATIONAL DAY FOR
THE ELIMINATION OF VIOLENCE AGAINST WOMEN
AGAINST THE FORCED STERILISATION OF
GIRLS AND WOMEN WITH DISABILITIES
25th November 2009
Today, 25th November, International Day for the Elimination of Violence against Women, the European Disability Forum (EDF) joins the struggle against all forms of gender violence, to which thousands of women in the European Union and worldwide fall victim.
In light of the United Nations Convention on the Rights of Persons with Disabilities (Article 12, Equal recognition before the law, Article 16, Freedom from exploitation, violence and abuse, Article 17, Protecting the integrity of the person, and Article 23, Respect for home and the family), EDF recognises that forced sterilisation is a form of violence that violates the rights of person with disabilities to form a family, decide on the number of children they wish to have, gain access to information on family planning and reproduction, and retain their fertility on an equal basis with others.
In light of the above, EDF declares:
a.. In several countries in Europe there is clear evidence that forced sterilisation continues to be carried out on many persons with disabilities, above all on girls and women with intellectual or psychosocial disabilities and without their consent or their understanding the specific purpose of the medical operation, under the pretext of the wellbeing of the person with disabilities.
a.. For many girls and women with disabilities this experience, to which they are forced against their will, intimidated and pressured, is a denial of their right to access appropriate services. Their fundamental human rights, including the right to safeguard body integrity and maintain control over their reproductive health, are violated and removed, at times without their realising.
a.. The consent of the parents or person that represent a girl or woman with a disability, when requested because of her minor age or previous legal incapacitation, must in all cases be based on the respect of the human rights and will of the women or girl with a disability. It is also the responsibility of the relevant medical personnel to ensure that the woman or girl with a disability is adequately informed about the fact that the surgery or medical intervention will lead to her being sterilised and the consequences of this for her future.
a.. Women and girls with disabilities have the same right to maternity as other women. Adequate services are the solution for ensuring that women in need of support can enjoy this right fully.
In light of the above, EDF calls for:
a.. All public powers to revise the legal framework regulating forced sterilisation, addressing the issues of "informed consent" and "legal capacity" in order to make the necessary accommodations and fulfil the spirit of, and obligations under, the Convention, which requires signatories to introduce legal reforms acknowledging that respect for the home and family and the dignity and integrity of persons with disabilities are fundamental rights which may not be violated.
a.. Studies to be undertaken to bring to light the reality of sterilisation in Europe in the case of persons with disabilities, such studies to include the perspectives of gender, age and type of disability and offer accurate statistical data on forced and therapeutic sterilisation.
a.. Necessary measures to be taken in terms of awareness, information and training aimed at both the families of girls and women with disabilities who are most vulnerable and at greatest risk of suffering forced sterilisation, and professionals, above all health care professionals and those involved in the legal field, to ensure they listen to the voices of girls and women with disabilities during legal investigations and proceedings. These measures shall be taken in close co-operation with representative organisations of persons with disabilities.
a.. Appropriate schemes must be developed with the objective to ensuring both that pregnant women and girls with disabilities get support in preparing for maternity and that mothers with disabilities in need of support to take care of their children have access to adequate assistance and services.
