I would say that it is not generally a problem until the developers make
it one. If it is well managed and care is taken during the demolition
and the material is segregated for disposal then all well and good.
However, once a 30t machines bucket has gone through it and then through
a crusher then believe me it is a problem. Developers will generally
ignore the simple approach as they are not necessarily thinking like we
do. I have seen many cross contaminated piles of material throughout the
country fit for nothing other than special waste disposal and when
developers are faced with the disposal and management costs after the
fact; it's a wake up call they didn't really want to hear. There is no
problem with avoiding this situation through a planning condition as it
meets the tests. Better to have tried to avoid the extra work in sorting
it out when it's all gone pete tong. Notes to consents are generally
unenforceable where a good well worded "negative" and "enforceable"
condition does the job. You can have slate roofs removed for reuse
through a planning condition so why not the removal of asbestos for
disposal!
Yes it may be so that it doesn't constitute a pollutant linkage in its
current condition but take it a bit further, will the site be suitable
for the proposed use when its been cross contaminated with a few tons of
asbestos cement sheet roofing and there has been receptors introduced?
I've seen it before all too often and that's with conditions.

the asbestos (I asume it is in good condition and still on the roof of a
building) does not pose a pollutant linkage if it was to remain.
The issue is to prevent contamintion of the site though poor
handling/removal and to protect the workers. As previously stated this
is not the job of the planning permission. this is the job of the
asbestos regulations, H&S@work legistaltion and the waste regs.
I usually get an advisory note added to the planning permission this
covers the council as they have informed the applicant that there may
be an issue with asbestos on the site and referred them to the
appropriate authority..

Why don't the standard conditions apply, you have in the Level 1
assessment identified a pollutant linkage that needs addressing?
There shouldn't be a need to have contaminant specific planning
conditions.
