Far be it for me to criticise but I think your comments are rather disparaging and not conducive to joined up working. This is not what I would expect from a DP professional!!

I think, Trish, you need to join me and others in taking the details and filing complaints.  We know that the Information Chihuahua really doesn't take much notice until a huge tsunami of pressure has built up.

Oddly I had a reply form them today on a PECR complaint about a credit card company that says more about you than cash ever can whose US division emailed me, "unsure" whether this fell into their jurisdiction.

I argue strongly that it does, but this is not the first time I have had to teach the Chihuahua the law, or at least my interpretation of it.

	Glad you brought this up, I was thinking the same thing the amount of prerecorded calls I am receiving including evenings is getting beyond a joke at my house considering I am registered with the TPS.  I have got to the stage now where I have started to "unplug" my landline and asking friends and family to contact via my mobile.

	 

	For an interim solution I am currently in the process of changing my number - but until then the phone will remain unplugged as far as I am concerned they are unsolicited calls and therefore in my opinion complete violate the PERC.

	I want to run my thoughts past you so you can correct me or adjust my thinking.
	
	I've blogged about it here: http://timtrent.blogspot.com/2009/10/cancel-your-loan-and-pre-recorded.html 
	
	A n organisation, "Company", contracts with a call centre in a dodgy part of the world (no, not the EEA) to make calls on its behalf to the UK domestic phone book, ignoring TPS registration, and using prerecorded calls thus, presumably, breaking the PECR.
	
	The contract instructs them to make calls to generate sales leads. The numbers may even be cloned until someone answers, but are probably form the phone book since they are targeted at domestic end users, the Individual Subscriber.
	
	Company has a registered office in Birmingham. It is even on the register of data controllers.
	
	I believe that, because it has a point of presence in the UK it is subject to the PECR whoever it contracts to make calls on its behalf. And I believe that it breaks the PECR with pre-recorded calls, and a second time if it calls TPS registered numbers.
	
	Am I right or am I barking mad?
