This is debatable. I understand from the wording in: General Medical Council
(GMC, 1998) Seeking patients' consent: the ethical
considerations.London:GMC,1998. www.gmc-uk.org
that implied consent is for when we allow our GP who is the treating
clinician and our advocate to examine and treat us. The information sheet
helps with the consent process, however ethically we should ensure its
comprehension. It is advisable to refer to it and ask if the client has read
and understood this and whether they have any questions about it.

I do not make reference to consent in my report. On the referral form in
my place of work the managers document that they have discussed the
referral with the client and by attending the appointment I would
interpret this as implied consent. When an appointment letter is sent to
the client, we also send out a letter explaining the role of OH and the
process. This includes reference to the writing of a report which will
be sent to management.

Dear list.
I have just been informed by one of the HR adminstering an SLA
contract
for OH that the management will rather not have the OHNA note in her
report
that verbal consent has been obtained reflected in the report
generated as a
consequent of management referral.
According to HR stating that You have verbal consent to discuss
and/or
advise management on the referral denotes a degree of partiality in
this
case it denotes supporting employees.
I will appreciate other members view on this.What can be termed as best
practice?
(1)To state that "I have his/her verbal consent to discuss the case
with
you"
OR
(2) Not to make referrence to employee consent at all in the report
generated.
