As Marcus has pointed out and Joanne agreed, this should refer to the Environmental Damage Regulations or more strictly:
the "The Environmental Damage (Prevention and Remediation) Regulations 2009" which constitute SI 2009 No. 153 and apply to England (http://www.opsi.gov.uk/si/si2009/uksi_20090153_en_1)
The relevance to brownfields should be very limited as the regulations deal with new (post 1 march 2009) damage (with a few minor caveats that I am sure Valerie Fogleman will clarify at CIRIA's event on 29 September).
