AHDS Performing Arts had a lot of experience with these sorts of issues.
Our focus was very much on the digital, however the issues can be
generic so some resources that you might find useful are:
AHDS Case Studies - Developing Licence Agreements (Seeking and
negotiating the rights to digitise images); Tracing Copyright Holders;
Protecting Copyright (How one project dealt with its resources being
copied without permission); and Working with the AHDS. All available at

Or the Information Papers:
Copyright and Other Rights Issues in Digitisation:

Subject: Theatre Archive Collections
We are in the early stages of negotiating the deposit of a collection of
records from a local theatre company. I would be grateful to hear from
other repositories who have experience in this area, in particular the
tricky issue of the variety of Intellectual Property Rights vested in
scripts, films, photographs etc.
With many thanks
Sarah
