Play.Com are in Jersey, aren't they? The law may be different there:
For example, the substantive Data Protection Law in Guernsey is the 2000
Law, which pretty much replicates the 1998 UK Act.
But Jersey only brought their version in much more recently with the
adoption of the Data Protection Law (2005).
I know that Guernsey and Alderney has had an equivalent of the
Telecommunications and Data Privacy (EC Directive) Regulations for a
while, but without checking we can't assume that Jersey has done the
same yet (give that there was 5 years extra lead time on the main Law).
The Data Protection Commissioner's website is at
http://www.dataprotection.gov.je which may have more detail.
