I maybe wrong here, I often am but...
You should be charging for EIR any way - Chapter 8 allows for this, FOIA, you can charge over a certain time/amount of info the client requires... so it depends on how long you talke to get the data, unless its freely available or commercially else where then sent the client off to find ti themselves, Isn't this what the E Gov Initiative is meant to be about?

UK radon may be charging that amount but i would imagine that if the HPA (as a public organisation), hold these records then houseowners, or LAs on their behalf, would surely have access to this information under the FOI or Environmental Information Regs?
If not then we will have to start passing on that fee to the solicitors. Sounds like a lot of admin for a few quid.

This has also caused us problems and we are currently trying to work a solution. In the meantime, we are replying to CON29 searches by stating we cannot accurately answer this question at the present time, but they can come and view the Indicative Atlas if they wish. It's unfortunate (although probably intentional) that the map provided by the BGS isn't at a scale where you can work out which areas are affected and which aren't. Like you however, the areas "affected" have significantly increased.
As for the digital data, the problem I see is that the charge is per seat, therefore you have to pay a very high price if you want more than 1 or 2 officers to have access. Try get your Land Charges Department to pay for it I'd say!

I'm interested to know how many CL Officers also deal with Radon enquiries. Have you received the new Indicative Atlas of Radon in England and Wales? Our area in West Norfolk has increased. This is likely to mean that properties previously not considered in radon affected areas are now included.
We have approached the BGS who provide the dataset digitally and will have to pay an annual fee for this data. This appears to be the only way we can get an accurate dataset. Residents enquiring about their home can go to www.ukradon.org to carry out an individual property search for a fee of £3.53.
Will this have implications for the CON29 question on radon affected areas? We will have to pay to use the data, residents will pay for their local land charges search and may also pay for the ukradon search too.
