Its very interesting isn't it? You state 'time away from work' and that is the key - if its time AWAY from work its not an issue is it but this is not, its extra work.
Working a second job which causes you a detriment resulting in you being unable to provide regular and sufficient service to your primary employer - or puts you at increased risk of accidents/incidents - is your employers business and should be addressed by HR. This is the reason why people working in safety critical roles typically have a contractual obligation to report second jobs. An individual needs to have time to recuperate and this is usually by not working - although some workaholics seem to be rejuvinated by the extra work!
Where there is no impact of the second job and no contractual issue then that would be different (assuming they pay taxes/NI etc!!

yes I know about this but the question I have still remains, and that is,
during a day-off or annual leave can the employer stipulate that the
employee cannot undertake any other paid work for another organisation?
Whilst I appreciate the Regs, surely they cannot and do not have any impact
on 'time away from work' (full-time/normal working hours that is).
For example, If you have this coming Monday as a Bank Holiday, and you wish
to work for an external company or agency, surely you can and it has
nothing to do with your employer?
