At the launch of his annual report last week, Richard Thomas foreshadowed new ICO guidance on defining personal data, drawing on the Article 29 working party paper. He said he thought it would be possible to reconcile the Article 29 working party approach with the Court of Appeal decision (Durant). He hopes to issue this guidance in the next few months.
