What we have to understand is that the difference between these things
is something that has to be defined in law. When the Comms Act was being
debated, there was a great deal of discussion as to how you can put one
or other communication into clearly defined different "boxes". Was a
website broadcasting, or not, for example. I always felt that the only
way it could really be resolved was to define "broadcasters" as a set of
people on a list maintained by the ministry.
Trying to work it out using definitions of networks and so on was always
going to raise questions further down the line (although the rules are
actually quite clear, even if some people might think they aren't
"equitable"). The one thing we *did* manage to do was ensure that
*technology* was never a criteria. Which is why it's disappointing to
see TICO making sweeping statements about Bluetooth.

New media generally doesn't have watersheds and doesn't conform to
"broadcasting" rules. That's just life, I'm afraid. Ofcom has a role in
making sure things don't get too out of hand, but broadcasting of the
kind which does have watersheds was very clearly intended only to apply
to boxes in the corner of the living room that looked and quacked like
conventional TV sets (and even then, not if it was on-demand
programming).
