Subject: Bangladesh EEZ claim
Content-Type: multipart/alternative;

Dear Colleagues,

I recently ran across an article by Khurshed Alam (
http://www.thedailystar.net/law/2006/06/02/analysis.htm)
which depicts an EEZ claim for Bangladesh with
lateral limits along meridians of longitude through
the termini of the land
boundaries. I am unaware of such a claim being
published by the government of
Bangladesh. If anyone has further information on this
claim, I would
appreciate a reply.

Thanks,
Dan Dzurek

greetings
& no hard data for such a published claim
but only some circumstantial info if useful

an official or nearly official view from dhaka in 2003
http://www.thedailystar.net/2003/10/01/d31001020323.htm
incidentally includes geocoords for south talpatty
island
which
at nlat21d30m x elong89d09m06s
suggest the western terminus or point number 1 of the
peculiar but official bangladeshi coastal baseline
as described & sketched here
http://www.bdix.net/sdnbd_org/world_env_day/2004/dispute/boundary.htm
& situated at nlat21d12m x elong89d06m45s some 18nm
southward or seaward of south talpatty
lies in fact a couple of minutes westward too from
this disputed island

indeed based on the best map i could find
http://www.lib.utexas.edu/maps/ams/india/nf-45-12.jpg
the baseline terminus would appear to lie a good deal
farther west of the island than east of the indian
bank of the border river mouth

& this notwithstanding the rather more balanced
looking view presented by the map on pdf p81 in the
link just below

but in any case these data do suggest the western
maritime claim limit of bangladesh may proceed if not
due south from the land boundary terminus with india
then possibly even a hair west of due south there

conversely however on the myanmar side
even such outlying bangladeshi islands to the east &
south as are mentioned & mapped on pdf p51 here
http://www.google.com/search?num=20&hl=en&client=safari&rls=en&q=%22south+talpatty%22+hoque+nippon&btnG=Search
do not prevent the eastern limit of the official
baseline & actual or potential maritime claim from
deflecting a bit westward from the land boundary
terminus
rather than projecting quite due south there
since the baseline terminus on the east
aka point number 8
is situated actually several minutes west of the land
boundary terminus & islands

still the same bangla official linked above reasoned
further in 2004
http://www.thedailystar.net/law/2004/02/04/index.htm

& again in 2006
& in fact shortly before the report you mention
the same official said bangladesh would be right to
claim a rectangular orientation & the full extent of
its marine zones per unlos
http://www.tamilcanadian.com/page.php?cat=466&id=4073

some evidence of the diplomatic incident last spring
that may have given rise to these new assertions is
here
http://209.85.165.104/search?q=cache:O8pmKZmqj2gJ:www.indoburmanews.net/archives/archive06/aug_06/322+bangladesh+maritime+claims&hl=en&ct=clnk&cd=1&gl=us&client=safari

also of possible relevance
http://www.bdix.net/sdnbd_org/world_env_day/2004/dispute/alok.htm
http://www.bdix.net/sdnbd_org/world_env_day/2004/dispute/index.htm

but wouldnt the published official claims to 200nm
eezs such as
http://www.un.org/Depts/los/LEGISLATIONANDTREATIES/PDFFILES/BGD_1974_Notification.pdf
if not also to extended shelf claims
in themselves be a denial of truncation & shelflocking
by equidistance
since that effect occurs or would occur no more than
167nm out to sea

& thus dont these claims assert if not an actual
rectangularity of eez shape then at least something
more nearly rectangular & open ended
than triangular & shut

some perceived limits on but also some encouragement
for such views
http://books.google.com/books?vid=ISBN9004144617&id=RN0GnOcw0McC&pg=RA126-PA2&lpg=RA126-PA2&ots=1glYP264-5&dq=colson+smith+bangladesh&sig=5G0JXE5EjAvJ6_nmI9aJX477YLg

& finally a possibly official map showing the
rectangular bangladesh claim area
together with a detailed indian refutation or
dismissal of it
http://horizonspeaks.blogspot.com/2006_05_21_archive.html

not clear what if anything it all adds up to tho

cheers
