European legislation regarding contracting is dependent upon the
nature of the work; social and health areas are somewhat different to
other areas. It is to do with the nature of the organisation: a non-
NHS body is treated differently to an NHS body (when is a company
private and when is it public). This is where things get messy and
with their usual aplomb the DoH are heading I feel for trouble. In
addition the size of the value of the contract is also important: for
health care it is different to industry.
