Amid the political shouting match and apparent administrative systems
failure (negligence?) demonstrated by the Home Office,
in dealing with notification of criminals convicted overseas, by filing
them in a paper-pile rather than adding them to the PNC
I think there might well be a breach of DP Principle 4 here?
DP Principle 4: "PERSONAL DATA SHALL BE ACCURATE AND WHERE NECESSARY UP
TO DATE".
So who is the Data Controller - Home Office? Or whoever is Data
COntroller for PNC?
Or whoever is responsible for updating PNC?
[Its usually the 'local police force' that does so, I think - even for
UK judicial decisions,
and I know there has been a long running saga over their collective
laxity in doing so (ICO vs ACPO) ]
I am unsure where the CRB comes into this except as a 'custodian ' of
the various Registers except
perhaps they might have a record of who has made CRB checks on these
people and therefore might have (potentially) employed them.
Bet Police cant pick up extra costs incurred from the Home Office.
Is the ICO likely to take any action in determining whether a breach of
the DP Act has occurred
or making an example of someone? The Home Office is no longer the 'hand
that feeds him".
