Dear Anne McGuire, Minister for Disabled People

We have met on numerous occassions now and you are fully informed of my case
here in the East Riding of Yorskhire Council andv otherb public bodies and
you asked me to write to you to keep you upadted and informed of my case and
I need to inform you that East Riding of Yorskhire Council are continually
discriminating and abusing my basic human rights and (again) are
thearatening to issue another civil injunction on me as an
Autistic/Neurodiverse professional disabled person to 'exclude' me from all
their 'public-buildings' in me asserting my 'disabled-voice' and peacefully
campaigning for better 'services' for myself and others children, adults,
familes and carers experiencing and struggling living with Autistic Spectrum
Disorders and/ or NeuroDiverse impairments and mental ill health/distress
and this is totally against the values of 'inclusion' and
'indpendent-living' which comes within the Disability Equality Duty.

East Riding of Yorkshire Council are wasting public money in continually
taken this unlawful legal action against me. There has been nearly a million
pounds spent in 'legal-fees' and other oppressive behaviour in then tyrying
to 'stop' my health and social 'care-plan' being implemented, which this
'money' would be better spent on my care and support and that of other
disabled people's needs being met in the East Riding of Yorkshire Council.

I know you have spoken with Adrian Whyatt and I know you are well informed
of other disabled peers and fellow professionals within my
'circle-of-support/friends' who are in my full support in this matter.

Can I plaese ask for your full intervention in this urgent matter which we
have discussed on the occassions we have met and you are aware that some of
my friends and colleagues within the Un Disability Convention are feeling my
pain, hurt and distress all this 'abuse' is causing me and I know Dr Linda
Misek-Falkoff, UN Disability Convention is very concerned and has intervened
and supported within my case all these years.

You'll will be receiving other emails on this matters from various
individuals and groups within the local, national and international disabled
peoples', ASD's/NeuroDiversity, mental health 'survivors', inclusion and
independent living movements who share my concerns at East Riding of
Yorkshire Council's continued discriminatory and abusive behaviour towards
me all these years now.

I include below a copy of your article to the BBC Ouch on the 'Disability
Equality Duty' Act that comes into force next week legally in the UK, but
like the DDA 1995, is being totally ignored by East Riding of Yorkshire
Council and other public bodies here in the East Riding and Hull localities
as I have experienced to my peril suffering all this abuse all these yaers
as an Autistic/Neurodiverse professional disabled person trying to
'speak-out' for myself and others, but at what cost to my health and
wellbeing and equality of opportunities annd quality of life.

My own social worker, Jayne Wlaker, who is employed by the Council has
written to the East Riding of Yorskhire Council legal deaprtments and senior
managers expressing about the threats' of 'injunctions' and court action and
the impact it will have on my mental health and the their behaviour could be
greatly be
damagaing to all the 'good-work' I am doing with my 'social-worker' who is
trying to 'include' me and find me an 'home' and specialist 'support' to
enable my 'independent-living' and improve my quality of life and equalities
of opportunities within my professional education and career and employment
prospects and implement my health and social 'care-plan' with Health and
other public bodies within my case after all these years of being embattled
with them since 1995 as you are fully aware and informed of.

How many times have you tried to access a 'public service' and found
yourself unable to?

When you need to see a doctor, visit your local library or access any sort
of service, you have a right to expect it to be delivered in ways that are
appropriate to your needs.

After all the core value of a public service is that all citizens should
benefit.

Yet for many disabled people this doesn’t happen and there’s a lot still to
be done to successfully challenge this sort of inequality.

That's why this Government introduced a duty for the public sector to
promote equality for disabled people, as part of the Disability
Discrimination Act (DDA) 2005.

The Disability Equality Duty - which comes into force on December 4 - will
place a legal responsibility on people working in the public sector to
promote equality for disabled people in everything they do.

NHS trusts, local councils, schools and the police forces are often
particularly important for disabled people, not just as service providers
but also as major employers.

That’s why we want the public sector to lead by example and think about what
more they could be doing to positively promote equality for disabled people.

For the first time, everyone from nurses on the front line to ministers
making policies will have to take responsibility for rooting out any
institutional disability-related discrimination that exists in their
practices and procedures.

So what exactly does this mean and what difference will the duty make?

Well, there are four key elements to the duty, which require organisations
to carry out their functions with 'due regard' to the need to:


eliminate unlawful disability discrimination and disability-related
harassment;
promote equality of opportunity for disabled people, taking steps to take
account of disabled people’s disabilities;
promote positive attitudes; and
encourage disabled people to take part in public life

Public sector bodies must produce Disability Equality Schemes setting out
how they will do this.

This is not just about getting people to put ramps at the entrances to
buildings and producing leaflets in alternative formats on request, although
these things are often necessary.

It’s about getting people to consider the needs of disabled people when
planning, delivering or monitoring their services.

Promoting equality for disabled people must be about thinking ahead and
including disabled people from the start.

Already there have been some excellent examples.

A council in the North East has recruited volunteers to act as ‘community
champions’ to help the town hall there communicate better with specific
groups.

They placed an advert in its magazine, which is sent to every household in
the area, inviting people with strong feelings about disability and equality
issues to volunteer for the role.

The group then met regularly throughout the year to help the council develop
its Disability Equality Scheme.

This is a great example of disabled people being included at the policy
making and planning stage.

At the moment the focus is on December 4, but this is only the start.

The hard work for public sector organisations will begin as they have to
turn their equality scheme plans into meaningful actions that benefit you.

The Government knows it will take more than legislation to achieve equality.

Public attitudes need to change too, to reflect the fact that disabled
people are equal members of society with equal rights.

And this is why we need the duty - to encourage people to consider the needs
of disabled people when planning their services, rather than responding to
individual cases, often when it is too late to meet them.
