The Circular published by DETR, or the Statutory Guidance or the Legislation do not say when a site event should be entered on the register; the Circular says this:

17.2 The particular details to be included in each REGISTER are prescribed in regulation 15 of, and Schedule 3 to, the Contaminated Land (England) Regulations 2000 (see Annex 4).  Neither these Regulations, nor the primary legislation in Part IIA, state when details should be added to the REGISTER. In the Government's view, this implies that they should be added as soon as reasonably practicable after the information they contain is generated; so, for example, the prescribed details of a REMEDIATION NOTICE should be added as soon as reasonably
practicable after the service of that notice.

To me this implies that when you have done an action, enter it on the Register.

My understanding is the land will only go on the register at the serving of a remediation notice therefore encouraging voluntary remediation

determination on the register in its own right).

I am about to determine one of our landfill sites as contaminated land
and have been informed by our legal team that the determination only
goes on the public register after service of a remedial notice. I
thought that as soon as the determination is made that it is placed on
the register, which seems to be make sense as service of remediaiton
notice may not be necessary.

Can anyone confirm the part of the guidance/ legislation that states
when the determination document is placed on the public register.
