That was really my point - a uniformed warden in the street using a real
camera is by its nature overt rather than covert. The problem with
camera phones is that their small size etc., might be construed as
making their use "covert".

It matters not what form the camera takes - built in to a phone, digital

conventional film. If the device is used covertly then a RIPA
authorisation
is almost certainly required.
The traffic warden was obviously using the camera overtly (so RIPA
doesn't
apply) and I imagine that the purpose would have been the legitimate one
of
recording that the car had been parked illegally and was being removed
in a
proper manner.
