I looked at the web site advertised to the group and wondered.
Is it just me, or do others think that the opt-out from future marketing
should be on the same screen as the data capture, rather than referred to in
a privacy statement on a separate page and requiring the sending of a
separate e-mail? So that would be a breach of Principle 1 (Fairness) as
well as 6 (Data Subject rights).
While I do not begrudge providing some information in return for a free
sample of a newsletter, I also query whether all the information requested
is strictly relevant. So there goes Principle 3 as well.
And while we're at it, I think the Electronic Communications Regulations
would require an opt-in for future e-mail marketing, since someone
requesting a free sample newsletter has not provided their details 'in the
course of a sale or negotiations for a sale'. (Not forgetting also the
requirement for 'a simple means of refusing [future marketing] at the time
the details were initially collected ... ' - so, again, where's the opt-out
box?)
Or am I being overly picky?
