Oh the damage exists. The charity has been struck off the list. Small beer
for them, though we did used to support it, and it has aims we agree with.
Until that marketing stunt, that is! I chose for reasons of cost not to
change my mobile provider. I have a historical and beneficial contract that
really made renewal a no brainer. Besides they are the devil I know.
The only body with any teeth in all this is the ASA, and those teeth are
really only bad publicity.
It’s about time the UKIC started enforcing. Education has gone on quite
long enough. I am so sick of bad marketing being sent out because the UKIC
chooses to wag his tail instead of biting their ankles.
I have a personal policy now of making a formal complaint every time. A
bookie emailed my private email address out of the blue today. Apparently
they will match a £30 bet with £30 of their own for me. The odds on racing
certainty is that I am about to report them as well.
Now I know that some DPOs on this list will be raising their hands in horror
over this. And I also know I am Don Quixote here in some ways. But equally
my profession is to advise people on good quality, legal, ethical marketing,
and I refuse to allow my standards to be compromised here by incompetent or
plain shabby marketing people.

Are you changing your telco provider, has the charity been struck off your
donor list, how much do you think UKIC will fine either transgressor, what
will TPS do and who reads the ASA adjudication pages (and then changes their
purchasing behaviour)!?
I suggest there is still too little motivation (punitive or otherwise) for
most marketers to take the legislation seriously, it has to balance with the
business case. Perhaps UKIC could take a leaf out of the FSA's "Big book of
fines".
