Everyone who has corrected me about the ADA and advertising occupational
requirements is correct, but who would have standing to challenge an ad
which was wrong? If the employer is consciously trying to avoid the ADA
requirements, he/she would immediately change the requirements during an
interview and find some reason to not hire the applicant. If a
governmental agency challenges the ad, the employer would simply stop
advertising and escape any penalty. In the meantime they have discouraged
any pwd from applying which was their original purpose. Therefore, I
argue that an employer can put anything they want in the ad.....David
