I would think that it could (not would) be an issue if the persons are named
in the caption and have not given written or implied consent or in cases of
tresspass and use of telephoto lens where the principal subject in the image
is a named celebrity and can prove financial loss. If someone merely gets in
the way of a photo in a public place or where consent to be on the land is
given or implied, then I would doubt if the courts would give cases under
the act any weight.
