Not yet reading the article and thus not commenting on your thoughts on this
matter, doesn't taking a position diametrically opposed to the views of the
OIC, however well thought out, make life a little challenging for those who
follow such advice?
Is there case law to back either position, or are we waiting for an
unfortunate set of council tax payers to fund the first defence?

This is a subject on which colleagues as well as the OIC have different
views.
Essentially this is a question about local authority powers. My own personal
view is that Council tax data can be used for other legitimate council
statutory functions and debt collection provided that the Fair Processing
Code is complied with.
I do not agree with the OIC who says that the use of such data is ultra
vires. I have set out my views in an article published in 1999 and which
remains my view.
