The University of Wales has been asked (for the first time to my knowledge)
to draw up a confidentiality agreement for an external examiner who is due
to examine a PhD thesis to sign. The thesis is subject to a successful 'bar
on access' application (to protect intellectual property rights) in
accordance with regulations we have had in place for many years.
It would be useful to know if colleagues at other institutions have used
such an agreement for external examiners previously, and also whether the
practice of placing bars on access on research degrees has been reviewed at
your institution following the implementation of the Freedom of
Information/Data Protection Acts. (I understand that the DPA relates to
personal information so is unlikely to be relevant but that the Freedom of
Information act allows exemption from disclosure on the basis of commercial
