For a while there I thought I was alone on this one Graham, but after
reading this guidance again I cannot see the problem with it. I'm not at all
sure what Paul is on about. In general the samples will be taken by police
surgeons, but if a police surgeon is not available they will not ask the
treating doctor to sample. Analysis is then delayed until patient consent
can be obtained. Even the chain of evidence is not a problem when you look
at paragraph 10 (the sample is taken away by the officer). To my mind this
legislation appears wholly sensible, and it removes a farcical loophole in
the law that has obstructed justice for years.
