I have been considering proposals from a project team who are planning to
video children in school, the purpose of which is to produce teacher
training material. I took the view that positive parental consent should be
obtained, even for the general class filming because the children would be
clearly identifiable.
I spoke to a Compliance Officer at the ICO this morning. She said that in
respect of the filming of the class, it was certainly best practice to
obtain positive consent. However, she thought an opt out would be
acceptable if one could be confident of it reaching parents i.e. by the
school posting it to parents (rather than sending it home with children) &
suggested that a tel no of a contact person be given if they wished to raise
any objections or concerns.
This is somewhat different advice and rather surprised me. I had understood
that an opt out couldn't be relied on if it was something that didn't have
to be returned (although that was in a different context)
