They are still under the current legislation SAMs in England too. I understand why Ancient has been dropped but why can't the same code be used?

I agree - this list should cover all UK regions. Is the Scottish situation
covered by separate legislation - ie do we need two terms in the list to
cover this?

Probably not, since you are hoping to standardise for the UK as a whole
rather than England. Although England has changed them to Scheduled
Monuments, in Scotland they are still Scheduled Ancient Monuments (SAM).
