I have been struggling with this as well.
I think the news item I saw was ambiguous in that the Commissioner talks
about "someone" retriving the message.
If this "someone" is the sender of the message, I cannot see the problem,
If however, my manager can retrieve my sent messages, I can.
Does the software permit the latter> This is the only way which I can see a
DP problem

If this has been reported accurately (and I note the story isn't
available any more), then they have it wrong. Twice.
Firstly, it's not an interception unless someone other than the intended
recipient or sender sees the message. Now try to tell me someone other
than these two does.
Secondly, and email is a communication until delivered to the recipient.
It doesn't matter where in the chain of delivery it is, if something
happens it's the same.
