It depends. Is the person identifiable? Is he/she well known? Is the
person kissing or holding hands with someone else's spouse? Would we like
our images being used without our permission? Would we expect a fee if the
promotional material was generating an income? is the person under 14 years
of age, requiring parental consent under agreed codes of practice in
publishing? Copyright remains with the person taking the photograph unless
he/she was specifically employed to take such a photograph. If the
photograph was taken without permission but was in a public place, unless the
photo shows them in a bad light, there should be no insurmountable problems.
I know there are more questions than answers here but it isn't that simple.
