Press Notice No. 12 of Session 1999-2000	10 February 2000

CULTURAL PROPERTY: RETURN AND ILLICIT TRADE

The Culture, Media and Sport Committee invites written evidence as part of 
its inquiry entitled Cultural Property: Return and Illicit Trade (formerly 
entitled The Return of Cultural Property).  Among the issues on which the 
Committee would welcome written evidence are:

The Illicit Trade

* The impact of the illicit trade in cultural property;

* Methods of counter-acting this illicit trade and the impact on the 
legitimate trade;

* The policies and procedures of museums relating to the acquisition and 
return of cultural property which has been illicitly removed;

* The operational effect of European legislation relating to the return of 
cultural objects unlawfully removed and prospects for further European 
legislation;

* The advantages, disadvantages, requirements and consequences of United 
Kingdom ratification of the 1995 UNIDROIT Convention on the International 
Return of Stolen or Illegally Exported Cultural Objects and the 1970 UNESCO 
Convention on the Means of Prohibiting and Preventing the Illicit Import, 
Export and Transfer of Ownership of Cultural Property;

Other Return Issues

* Claims for return of items of cultural property which were historically 
removed and not necessarily acquired as a result of the illicit trade;

* The policies and procedures of museums relating to such claims, including 
solutions other than return;

* Guidance and advice for museums from central sources on acquisition and 
return;

* Current legislation relating to return and other solutions to claims and 
arguments for and against legislative change.

Individual cases

The Committee is willing to receive submissions relating to individual 
claims for return, but expects its Report arising from the inquiry to 
concentrate on general policies towards return and the illicit trade rather 
than making recommendations relating to individual claims.

Evidence

The Committee would welcome written evidence for this inquiry, ideally by 
Friday 10 March.  The Committee will begin taking oral evidence late in 
March and hearings will continue until after Easter.  Those wishing to be 
considered by the Committee for invitations for oral evidence should 
contact the Clerk of the Committee before the end of February.  Those 
wishing to know more about the inquiry should contact Nicole Mulloy on 020

GUIDANCE FOR THOSE WISHING TO SUBMIT EVIDENCE

1.	Written evidence should contain, if appropriate, a brief introduction to 
the persons or organisations submitting it (perhaps stating their area of 
expertise, etc), and any factual information they have to offer from which 
the Committee might be able to draw conclusions.  It is also helpful to 
include any recommendations for action by the Government or others.

2.	If written evidence is very brief, it can be sent in the form of a 
letter, but otherwise it is helpful for the evidence to be in the form of a 
self-contained memorandum.  Memoranda should have numbered paragraphs (if a 
memorandum is later printed, page numbers will change, so it is helpful to 
be able to refer to paragraph numbers).

3.	Supplementary material (leaflets, articles, etc) may also be sent, but
it is helpful if the memorandum itself is self-contained (summarising the 
main points made in the supplementary material if necessary).  This is 
because material published elsewhere is not usually printed.

4.	All communications should be sent to the Clerk of the Committee by post,

5.	Once written evidence has been submitted it becomes the property of the 
Committee and it is for the Committee to decide the manner and timing of 
its publication;those submitting written evidence should consult the Clerk 
if they wish to seek the Committee's agreement to make their evidence 
public themselves; there is no objection to outlining the views expressed 
in evidence.

6.	Unless indicated otherwise it will be assumed that those submitting 
written evidence have no objections to it being made public by the 
Committee. If witnesses give oral evidence, copies of their written 
evidence will usually be made available to the press and public at the 
hearing, and may thereafter be treated as in the public domain.  Written 
evidence submitted by those not giving oral evidence will usually be made 
public by the Committee at the end of the inquiry.

7.	Those wishing to be considered for invitations to submit oral evidence 
as part of the inquiry should write to Colin Lee, the Clerk of the 
Committee, at the above address before the end of February.
