UNCOVER CLASS ACTION SETTLEMENT
This lawsuit is a copyright infringement class action. Plaintiffs
allege that, through the operation of an Internet-based document
delivery service known as "UnCover", Defendants offered for sale,
sold and/or delivered copyrighted literary works ("articles") to
customers without the prior permission of authors who retained a
copyright in the article and without paying those authors copyright
fees. This class action has been settled without any admission of
liability by Defendants. You could be a member of this class
action if all three of the following conditions are true:
1. You authored or co-authored an article that was created and/or
published after December 31, 1977 AND;
2. The article was reproduced or distributed by UnCover between
October 22, 1994 and July 12, 2000, inclusive AND;
3. You retained the copyright and future rights to publication of
the article.
All three conditions must be true for you to be a member of this
class and to be entitled to share in the settlement proceeds.
THE DEADLINE FOR SUBMISSION OF CLAIMS IS FRIDAY OCTOBER 27TH, 2000.
Instructions
Submitting your claim will be much easier if you perform the
following actions before you begin the claims process:
1. Please review all documents and information pages on the website
completely before submitting your claim: you will not be able to
review documents and information pages while you are submitting a
claim, unless an express link is provided to you at that point.
2. Pick a time when you will have 2030 minutes of uninterrupted
time to complete the claims process.
3. Have a list of your publications since 12/31/77 nearby,
including the date and journal of publication, and any co-author
names.
4. Review any publisher contracts to determine if you retained
the copyright and your right to future publication of the articles
you published.
5. Review the web page on copyright law so that you know definitively
if you have retained the copyright and future publication rights.
6. If your work was registered with the US Copyright Office and you
do not have the copyright registration number, get your registration
information from the Library of Congress, including registration
month and year, registration number, and title of registered work.
Registered works will be compensated at a higher rate than
unregistered works.
