I would make the comment that the great majority of people who have suffered
from stress (and many other conditions) are not in the least litigious and
never would be no matter how many solicitors court them. I do accept the
point however that companies are often driven to devise policies in the hope
that they will be protected in some way regardless of how, and if, the
policy was communicated.
In my experience I have found organisational audits useful as it is
obviously rather more useful to look at the (real or perceived)
organisational causes of stress rather than the individual and his/her
coping skills.
I have used the CALM (not wanting to advertise but to share learning) audit
very useful and it is user friendly and easy to see what actions are
required.
A final comment is that it is interesting how times have changed in OH -
when I started the attitude was almost to encourage you to "leave your
personal/social/financial problems at the gate" as if people were able to
be two personalities - thankfully now we look more holistically!! Jane.
