Your questions are really good.  I want to think a little more about
them before trying to answer, but you have certainly framed an important
question.

I do agree that rights based legislation is critical.  One of the issues
thought is not only whether the legislation is enforceable, but whether
there are mechanisms that allow people who are disadvantaged to have
access to the justice system.  In Canada there is a federally-funded
Court Challenges program which was set up when Canada adopted a Charter
of Rights and Freedoms in 1982.  This program provides funds to equality
seeking groups to bring cases in courts relating to the equality rights
provisions in the Charter (no discrimination on the basis of a number of
grounds including disability).  There are limitations to the program,
but it has helped to ensure some access to the courts.
