Hi,

For what it is worth, I would say that there are 2 separate data controllers in that arrangement. Clearly as the barrister has complete discretion as to how to conduct the case and what information is to be used for, he is a data controller for that information However, the PPS, by the same token, has no control over the information in the barrister's possession either so cannot be a controller for that information.

This makes the PPS and the barrister separate data controllers for the information that each holds but not joint data controllers as they are not equals.
