Draft Brexit Data Protection Regulations would undermine adequacy determination for the UK

Highlights:

 

 

  1. The Transfer arrangements in Draft Brexit DP Regulations published last December undermines UK's prospect for an adequacy.

 

  1. Powers used do not need data protection input and are not likely to be scrutinised by Parliament

 

  1. The Gov. has also removed the requirement that the ICO is independent;

 

  1. Finally, the UK version of the GDPR could change rapidly by use of these undebated powers.
