Help would be greatly appreciated (asking for personal reasons rather than work).

 

 

My local Hospital employs a set of chaplain’s (for all faiths) the Hospital previously would give the Chaplin’s a list of which patients were in hospital and their religion but have since stopped “because of GDPR” and obviously this is causing some difficulty in the chaplain’s visiting patients of those religions – they used to go to their bedside, introduce themselves and ask if they would like any services e.g. prayers etc. The hospital says obtaining explicit consent isn’t practical.

 

I am trying to find a relevant section of the GDPR/DPA 2018 that would allow the Hospital to give their employees (the chaplain’s) a list of patients, ward and religion.

 

I was wondering if this would apply or does anyone know where else I could look?

 

“(g) processing is necessary for reasons of substantial public interest, on the basis of Union or Member State law which shall be proportionate to the aim pursued, respect the essence of the right to data protection and provide for suitable and specific measures to safeguard the fundamental rights and the interests of the data subject;

Recital 55: Public interest in processing by official authorities for objectives of recognized religious communities - Moreover, the processing of personal data by official authorities for the purpose of achieving the aims, laid down by constitutional law or by international public law, of officially recognised religious associations, is carried out on grounds of public interest.”
