I suppose it’s going back to OH basics and asking the question about health affecting work and work affecting health. If these dependents are not employed under a contract with the company you provide a service for then where does it leave that dynamic, what are you going to report and what business is it of the welfare service to know about the health of these dependents anyway? Like others have said I think its about going back to your SLA, asking yourself how competent you feel to do this professionally, legally where does this leave you both in terms of data protection law and your indemnity insurance and morally is it your role to know about the health of what is essentially a 3rd party to employees.

This is what I’m trying to do. Our contract says nothing about seeing dependents and this is the first time since I started working with them in April that it’s been expected.

Dear All

 

I need some advice on a dilemma that has recently confronted me.

 

I provide an OH service to a specific industry via their welfare service but last week had 2 dependents of industry staff booked in to see me. Both have complex health issues but I felt uneasy about what expectations they and the Welfare service had regarding potential outcomes. I am currently having a dialogue with the Welfare team regarding the reason for these dependents being referred and what they want from me. My concern is whether this puts me in a legally, ethically or morally difficult position. I had no prior warning that these were not industry staff and now I have been asked to submit an OH report for each. I feel very uneasy about this and would appreciate some advice.
