Hi Sarah, I had a client where we did exactly as you describe, but I stopped the practise as I considered it unethical and would not have stood up to legal scrutiny if challenged eg we were being asked to comment on the health needs of minors. 

There are also contractual and GDPR issues, its not some thing I would encourage and there are specialist companies that do this work much better that an OHA (eg Healix). How on earth can an OHA be fully aware of the healthcare facilities around the globe?

My advice is simple, dont do it, and if you have done it take some advice from the RCN/NMC. It does indeed put you in a difficult position unless it is viewed as some kind of "good samaritan " act but I am scraping the bottom of th barrel there

 

My comment would be

You doubtless have a contract, what does that say about your remit?

 

 

My questions would be

 

When did you become aware that these were not staff members?

If you became aware did you consider stopping the consultation?

What was the purpose  of the referral?

If they are not employees of what value is a report ?

Did the individuals give full infomed consent for the process?

What did the referral say?

Dear All

I need some advice on a dilemma that has recently confronted me.

I provide an OH service to a specific industry via their welfare service but last week had 2 dependents of industry staff booked in to see me. Both have complex health issues but I felt uneasy about what expectations they and the Welfare service had regarding potential outcomes. I am currently having a dialogue with the Welfare team regarding the reason for these dependents being referred and what they want from me. My concern is whether this puts me in a legally, ethically or morally difficult position. I had no prior warning that these were not industry staff and now I have been asked to submit an OH report for each. I feel very uneasy about this and would appreciate some advice.
