An interesting one has been brought up by a school with respect to use of photos.
It is fairly common for each student/pupil to have an image within the school Management Information System as this is integral to identification with respect to medical requirements and even safeguarding.
As a result you will find schools making use of Legal Obligation for the use of photos for this purpose, however there is a query about the use of Legal Obligation and the right to object.
My understanding, including from requests to ICO, is that whilst the right to object should not be considered when it comes to where you have used Legal Obligation (https://ico.org.uk/media/images/graphics/2258510/lawful-basis-table.png) there times when it has to be considered. If there are other concerns where other legal obligations need to be considered (restrictions on the use of images, the child is dual registered - i.e. mainly educated at another location but also registered at the school for specific reasons and cannot be identified) then the child or their carers can raise an objection.
But is this raising an objection or a right to restrict until the school has re-evaluated the purpose and lawful basis?
