So its not a discussion group like JISC mail lists (ie, this one), but unsolicited emails/complaints?

Article 21(1) applies if they are sending the emails to personal accounts (not group mailboxes) based on legitimate interests (Article 6(1)(f)).  The recipients could write to them and object (or you could do it corporately on behalf of them, perhaps) but then it's down to them to decide whether to stop sending them or not.  If they still receive them the recipients could then complain to the ICO and the senders can demonstrate how they have conducted a balancing exercise of their compelling legitimate grounds against the interests, rights and freedoms of the recipients(!).

If it could be classed as marketing there could be an absolute right to object, but I doubt whether that would make a difference to whether they continue to send them either.

I think there are potential options open to the recipients, but perhaps this receiving unsolicited complaints is perhaps just a cost of business of being a council employee!

It's processing on behalf of the Council; it's emails from what could be termed pressure groups / special interest groups which individuals are copied in to and where we are not the originator of the email.  Sorry for not making that clear originally.

Assuming this is within a work environment your use of the email address is on behalf of your employer as controller and would seem to be under point (e) of Article 6(1).

Unless person can bring themselves within Art 21 (grounds relating to his or her particular situation) I would suggest you can simply continue with reply all and if person objects refer them to the list controller. If they DO bring within Art 21 but want to remain on the list I would certainly see you may have a compelling argument for doing the same - it is their choice to be on the list with all that goes with it. It should not be for you to weed them out.
